He was quickly challenged by the ACLU, the Legal Defense Fund, the Asian Law Caucus, and others, who filed a nationwide class action lawsuit, Trump v. Barbara.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the 6-3 decision on June 30, the Supreme Court justices all decided, with the lower courts that took the case into consideration, that the order was unconstitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chief Justice John Roberts, who authored the court\u2019s majority decision, cited the&nbsp;<a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-14\/\"><strong>14th Amendment<\/strong><\/a>, which reads, \u201cAll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, the Supreme Court cited many pieces of research done on citizenship. One notable citation was Hirota\u2019s 2017 book, \u201cExpelling the Poor: Atlantic Seaboard States and the Nineteenth-Century Origins of American Immigration Policy.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court referenced a story in Hirota\u2019s book about an American-born Irish infant who was deported by Massachusetts in 1855, which was met with \u201coutcry.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court also cited \u201cThe Development of American Citizenship, 1608-1870,\u201d by Kettner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">UC Berkeley School of Law Dean Erwin Chemerinsky said when he first heard about the order Trump issued on his second day in office, he thought, \u201cThis is clearly unconstitutional.\u201d<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft is-resized\" id=\"attachment_5234\"><img data-recalc-dims=\"1\" height=\"345\" width=\"600\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/ccspin.net\/wp-content\/uploads\/2026\/07\/BCN-20220105-DEANERWIN-01-600x345.jpg?resize=600%2C345&#038;ssl=1\" alt=\"\" class=\"wp-image-5234\" style=\"width:517px;height:auto\"\/><figcaption class=\"wp-element-caption\"><strong>\u201cThere had been some right-wing fringe that had tried to make this argument in the past \u2026 (but) the overwhelming consensus was that the Constitution was clear,\u201d said UC Berkeley School of Law Dean Erwin Chemerinsky. To Chemerinsky, this order had nearly no chance of passing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the first time in more than 100 years that birthright citizenship has been challenged. The United States v. Wong Kim Ark in 1898 was an attempt to stop children of immigrants who were born in the United States, especially from Eastern European and Asian countries, from becoming citizens.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The consensus reached in 1898 was the same in 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s based on tradition,\u201d Chemerinsky said. \u201cUntil President Trump\u2019s second term, the law was clearly established for birthright citizenship.
